Edward Labayog, Alameda County code enforcement manager, presented the staff case that SEKK Investments Grove LLC had paved more than 50% of the property's front yard (citing Neighborhood Preservation Ordinance sections 6.65030 f.1 and 6.65030 b.6) and summarized the inspection timeline (site visit 11/27/2023; notices in November and January; final declaration and May 22 West BZA finding of public nuisance). Staff provided measurements (frontage approximately 125 feet, depth 25 feet, total front area ≈3,125 sq ft; 50% = 1,562.5 sq ft) and recommended denying the appeal and upholding the West County Board of Zoning Adjustment.
The appellant (online) requested more time to present slides and legal arguments, including a grandfathering claim that the paved areas predated the 1999 ordinance. County counsel cautioned about providing personal information on-screen and asked the appellant to submit materials in writing. The Board continued the item to the next planning meeting (noted as November 14) and directed that presentation materials be provided at least a week in advance for review. No final determination was reached on the merits.
