The Planning Commission recommended approval of a code change (11‑8‑3) to expand acceptable forms of subdivision improvement completion assurance. Staff said state law requires the city allow multiple forms of guarantee; the amendment would allow: a cash escrow account at a federally insured financial institution, a cash bond held by the city, or a surety bond from a licensed surety provider in Utah.
Community Development Manager Lance Evans told the commission the three options would better protect the city and assure completion of required subdivision improvements. No public comments were made during the hearing. Commissioner Gary Boatright moved to recommend approval to City Council; Commissioner Marty McFadden seconded. Commissioners Boatright, Losee, McFadden and Skola voted aye and the motion carried.
The commission’s recommendation forwards the amendment to the City Council; if the council adopts the change it will affect the paperwork and financial instruments developers may use to guarantee public‑improvement completion.
