Jason Matthews, the applicant for three variances at 408 Indigo Road, told the Board of Zoning Appeals he did not obtain permits before constructing an accessory building and asked the board to exclude an attached porch/patio from the square‑footage calculation.
"I did not obtain the proper permits before the construction," Jason Matthews said, adding that excluding a patio labeled as such would reduce the apparent overage from about 108.5 square feet to roughly 50–56 square feet. Steph, speaking for staff, said the applicant’s submitted survey lists the main house footprint at 1,641 square feet, which yields a maximum permitted accessory area of 820.5 square feet and a proposed accessory structure of 929 square feet.
Board members pressed the applicant on conflicting public records about the principal dwelling’s square footage and on which elements (porch, patio, heated garage) count toward the accessory‑structure total. Steph confirmed the 1,641 figure came from the survey provided with the application. One board member said the structure was "very big" and that the variance criteria—extraordinary and exceptional conditions unique to the property—were not met, arguing the structure would be a detriment to adjacent properties.
A motion to disapprove the area variance was made and seconded; the motion passed and the area variance was denied. The board did not identify any additional conditions that would justify an exception under the cited Chapter 151 provisions.
