Board reviews junior high's request for water-right credit; legal review requested

District staff briefed the board on water-right credits and a junior high school site that appears to be short approximately 30 acre-feet for irrigation and landscaping. Brett Palmer summarized the history: the Tooele County School District previously transferred roughly 12.94 acre-feet to the junior-high parcel when it was annexed into the district, but a subsequent water-right calculation showed the school is 30 acre-feet short. “...and they're 30 acre feet short,” Palmer said.
Staff reviewed Resolution 2020-1, which establishes policy for utilization of available district water-right credits and describes eligible categories (primarily infill single-family and certain nonresidential connections). Board members discussed possible outcomes — selling credits, facilitating a purchase for the school, or denying the request — and agreed that district legal counsel should first determine whether the school qualifies under the policy before the board takes any action. Several members noted that if the district did provide or sell rights, any funds could be directed toward large upcoming treatment upgrades.
