Attorney Sean Fredricks updated the board on several legal matters at the March 3 meeting. On the Hoplin/McLaughlin complaint, Fredricks said he prepared proposed modifications to a settlement agreement to clarify permitting responsibilities and to limit liability; the board previously agreed to hold the complaint in abeyance to allow the parties to negotiate, and Fredricks recommended the parties contact each other directly.
Fredricks also reported Dacotah Bank has withdrawn its complaint against Neil Breidenbach regarding Surface Drain Permit No. 6710; the board will continue to monitor Breidenbach's compliance with permit conditions, including obtaining written consent from the Buxton Township Board and affected landowners. Finally, Fredricks noted that motions to dismiss have been filed in the lawsuit brought by La Verne Koenig concerning obstruction complaint proceedings from 2017–2018. The board received the legal updates and took no additional action at the meeting.
