Council conditionally approves annexation of 35.5-acre Valley View Estates with pre-annexation agreement

Willard City Council voted Oct. 10 to approve the annexation of Valley View Estates, a 35.5-acre development at 7150 South 300 East, contingent on a pre-annexation development agreement requiring the developer to provide necessary water and sewer hookups.

City Attorney Colt Mund told the council that state law requires municipalities to annex only when they intend to provide services. "Under State Code the city must annex with the intent of providing services," Mund said during discussion, urging a written agreement to clarify service commitments and limit city liability. Nathan Rose, one of the applicants, said his paperwork ties the project into a planned water-tank project and that "there is 20-acre feet of excess water that could be used by their subdivision." Council Member Rod Mund moved for conditional approval and Council Member Jacob Bodily seconded; the motion carried.

The annexation had an initial public hearing during which Rose outlined infrastructure plans and explained that annexation is required to obtain building permits. The council earlier tabled formal action pending discussion of related items, then approved the annexation after the parties agreed to a pre-annexation agreement spelling out water provision, sewer hookups and compliance with Willard City building and subdivision requirements.

Why it matters: the decision allows the developer to proceed toward permitting while the pre-annexation agreement is intended to document who will fund and build necessary infrastructure. The council asked staff to prepare clearer annexation guidelines and scheduled a work session to discuss annexation processes and standards.

Next steps: The Roses must finalize the pre-annexation development agreement and demonstrate water and sewer commitments before the annexation is implemented; staff will review the agreement and the council may take additional action at a later meeting.
