The New Market Planning Commission voted unanimously Feb. 2 to send a conditional use permit for 9361–9365 North Congress Street to the Town Council for final approval. The CUP would allow expansion of residential use in the building and was forwarded after staff outlined parking solutions.
Planning staff, represented by Mrs. Medina, said the rear parking area has historically served residents, guests and employees. To address parking requirements for the proposed expansion, staff identified Section 70‑150(a)(3) of the town code as permitting two additional parking spaces for the change, which would avoid the need for a new ordinance for an older commercial building. Mr. King moved to forward the CUP to council; Mr. Mongold seconded and the motion passed on a unanimous voice vote, 5-0.
Commission members discussed the intensity of residential use versus commercial use and the practical effect on parking: Mrs. Medina said there are currently two residential spaces in the rear and that two more would be required if the expansion is approved. Mrs. Erbaugh noted Congress Street allows two‑hour parking and staff said customers would likely use on‑street spots while employees would park in the rear lot. The Planning Commission did not place a specific number of additional spaces in the motion, citing the potential for commercial units to change use in the future.
The matter will next appear before the Town Council for a formal decision. The Planning Commission did not make any changes to the building or parking requirements beyond forwarding the CUP for council consideration.
