Council authorizes drafting firearms code amendments to comply with state law

Town Attorney Thomas Benavidez told the council the town’s existing code contains provisions that may conflict with recent state law and asked for authorization to prepare ordinances amending sections of the Town Code.
Benavidez identified specific code sections the town intends to revise, including Section 18.100.210(D)(1) (Weapons Merchant Prohibited Home‑Based Business Use), Section 9.20 (Minors Prohibited From Carrying Firearms) and Section 2.55.070 (Fees Chargeable By Police Before Firearms Transfer). Council members voted to authorize preparation of those ordinances so the town’s code will conform with state preemption of firearms regulation.
The motion to authorize drafting of the ordinances was moved by Johann Wallace, seconded by Cynthia Butterworth, and passed unanimously. Further review and formal ordinance adoption would occur in future meetings after draft language is prepared.
