Board hires outside counsel for special township TIF issue and approves joint application in defense of lawsuit
Summary
The Board authorized Frost Brown Todd LLP as outside counsel on tax-increment-financing issues (not to exceed $5,000) and executed a joint application with the prosecuting attorney to employ outside counsel in Case No. 2025 CA 07 055 relating to a lawsuit filed by Municipal Clerk Paul C. Kamphaus.
The Board authorized the employment of Frost Brown Todd LLP to advise on matters related to Ohio Revised Code Sections 5709.77–5709.81 and 5709.63–5709.633 so a township in Clermont County may pursue an extension of a tax increment financing (TIF) project; the contract authorization caps attorneys’ fees and costs at $5,000. Gael Fawley, Clerk of the Board, explained that a change in state law prompted the request.
Separately, the Board authorized a Joint Application with the Clermont County Prosecuting Attorney to the Clermont County Court of Common Pleas for employment of outside legal counsel to advise and defend the Board in Case No. 2025 CA 07 055, State ex rel. Paul C. Kamphaus v. David L. Painter, et al., as permitted by Ohio Revised Code §305.14. Counsel Ryan Spitzer stated the application responds to Municipal Clerk Kamphaus filing a lawsuit regarding his budget. The Board voted to execute the joint application and related authorizations.
