Subcommittee adopts amendment to increase fines and allow seizure for motorized-vehicle trespass on rural property

Representative Butler described a problem in rural districts where property owners have fences cut and off-road "side-by-side" vehicles trespass on private land. The amendment he presented would make the first offense a $2,500 fine with restitution for property damage, require restitution and seizure of the vehicle on a second offense, and clarify the seizure is criminal in nature.
A committee member asked whether the vehicle would be "seized or repossessed," and Butler clarified it would be seized. After adopting amendment code 12956, the committee voted to send HB 22-84, as amended, to full judiciary (6 ayes, 1 no).
