Salem Township Planning Commission recommends lot addition for Penn Home & Farm, with conditions

The Salem Township Planning Commission on Sept. 4, 2024 recommended approval of Penn Home & Farm LLC’s request to add Lot 1 to the property of John and Patricia Kilpatrick (Tax Map No. 57-12-00-0-021), subject to a list of technical conditions.
Tom Spears, identified in the record as the property owner and sole owner of Penn Home & Farm LLC, participated remotely and presented the application. Resident Ken Brozack questioned whether a right-of-way exists to access the rear parcel; Solicitor Gary Falatovich explained that the Garden Courts Plan of Lots from the 1960s referenced two proposed 50-foot streets that were never dedicated or opened and that no easement was reserved, and that Penn Home & Farm will access parcel 57-12-00-0-021 from its adjacent parcel 57-12-00-0-032.
The Commission’s required conditions include showing on the plan: a front building setback line of 30 feet from Mark Drive and side/rear setback lines of 10 feet, labeling the driveway to the Kilpatrick dwelling, adding Mark Drive right-of-way width and identification, showing pre- and post-subdivision acreage, and identifying any sanitary sewer easement affecting the property. The minutes also note that a Non-Buildable Waiver for Lot 1 was signed and submitted, and that documentation must be provided confirming Penn Home & Farm LLC’s registered address and member(s) with the Pennsylvania Department of State. The plan must include a note stating that Penn Home & Farm owns 54 Mark Drive (Tax Map Parcel No. 57-12-00-0-032) and that access to parcel -021 from Mark Drive is available through that property.
Paul Holleran moved and Chair Connie Mattei seconded a recommendation of approval “subject to the conditions mentioned above.” Holleran and Mattei voted for the motion and it passed unanimously.
