City staff present updates to industrial pretreatment fees; ordinance scheduled for second reading Aug. 10

The commission heard a staff presentation on Ordinance O‑26‑18, which would amend city utility code sections to revise charges and fees related to the Industrial Pretreatment Program (IPP). Staff described the IPP as the federally‑mandated program that controls pollutant discharges from nonresidential sources into the public sewer system and said the ordinance includes new surcharges for total phosphorus, total nitrogen, fats/oils/greases and total dissolved solids. Staff noted the ordinance is based on a Jones Edmunds technical memorandum dated July 1, 2026.
City staff stated the ordinance would take effect Jan.1, 2027 if adopted and includes a provision for an automatic increase of up to 2.5% on Oct. 1 each year to account for inflationary cost increases. The manager recommended reevaluating the fees at least every five years or sooner if regulations change. Staff said there are presently three permitted industrial entities under the IPP (Ball Manufacturing/former Florida Can Manufacturing, New Dairy/formerly Borden Dairy, and Indian River Transport). A second reading was scheduled for Aug. 10, 2026; no final adoption occurred at the July 27 meeting.
