Attorney: prior 1980s zoning conditions and topography left site undeveloped
Summary
The applicant's attorney said both parcels were rezoned in the 1980s for developments that were never built and that steep topography and a stream make only about 0.84 acres developable; the rezoning request would remove prior conditions that restrict the property.

Alex Brock said the western parcel was rezoned in 1986 as part of a larger shopping‑center plan and the eastern parcel was rezoned in 1989 for a 10,000 square‑foot financial building; neither was built and the parcels were later subdivided off and remain vacant. He attributed the lack of prior development primarily to site difficulties: steep topography from Old Alabama Road and a stream that occupies roughly half the property's northern portion.
Brock said the applicant seeks to eliminate the prior conditions of zoning from the 1980s that would restrict new development. That history frames the current rezoning request, but the transcript does not include municipal staff comments removing or endorsing those prior conditions; that will be addressed during the planning and council review process.
