Board grants setback variance for Oriole Drive lot after petitioner cites odd, pie-shaped parcel

The Brown County Board of Zoning Appeals voted to approve docket 26-VAR-02, granting a side-and-rear setback variance for property at 6430 Oriole Drive in the Cordry Sweetwater Conservancy District.
Planning Director Kayla Robertson read the staff report and cautioned that GIS lot lines are not always accurate. Petitioner Derek Block told the board he had worked with an architect who found the existing house and garage encroached on the setback: "we didn’t know what the setback requirements were when we started the plans and were well into the process when [we] learned. The lot is odd, and pie shaped," Block said. He also said he purchased the lot adjacent to the property and has arranged with the county health department about septic placement across the street.
Board members debated precedent in the lake district, where small triangular lots commonly prompt setback variances. President John Dillberger said the board "routinely approves Variance requests in the lake district" because of the lots’ size and shape and suggested the board could consider clarifying the ordinance in a future meeting. Randy Jones said the unusual lot configuration made expansion difficult and expressed no real concerns about approval. Michael Harrison was the lone dissenting vote.
Mr. Dillberger moved to approve docket 26-VAR-02 "based on the findings," and Mr. Jones seconded. The roll-call vote was Michael Harrison—no; Randy Jones—yes; Jane Gore—yes; John Dillberger—yes, resulting in approval.
