Scruggs asked the commission to ask the city attorney for a written legal opinion explaining the applicant’s rights and the commission’s options and to waive attorney-client privilege if necessary so the public can see the opinion. Commissioners did not take action on the comment itself; staff later advised that legal questions raised by the public comment would be addressed in a proposed executive session so the commission can receive confidential legal advice before any formal public action. Stewart, the planning staff member who later reviewed the item for the board, confirmed staff’s investigation had found pictorial and cartographic evidence the board should consider.
