Council exempts development agreements from nightly-rental cap in ordinance change

The Toquerville City Council on May 20 approved an ordinance amending Title 10, Chapter 17, Section 4(H) to allow developments whose nightly rentals are authorized in an approved development agreement to be governed by that agreement rather than the City’s standard nightly-rental cap. The ordinance cites the municipal land-use process and incorporated state land-use code language.
City Attorney Kayla Gothard summarized the ordinance and the Council discussed how the change would interact with future development agreements. The motion carried 4-1, with Councilman Wayne Olsen recorded as the lone nay.
