Elk County commissioners deny Phillips Road petition, cite existing access and easement

The Elk County Board of Commissioners on Jan. 12 denied a petition to extend Road 4 to provide frontage to the Phillips property, finding that the property has access and is not landlocked.
Commissioner Jake Liebau moved and Commissioner Perry Russell seconded the motion “to deny the petition pursuant to KSA 68-117 that there is access to the property and it is not land locked.” The board also voted to decline to lay out a public road extension under KSA 68-102, noting an existing easement. Both motions carried 3-0.
County Counselor Paul Dean advised the board on statutory provisions during the discussion. No vote in favor of laying out a road extension was recorded, and the decisions were entered as formal denial of the petition.
