Planning commission approves Big Creek Estates 3rd Addition after counsel cautions on legal limits

The Ellis County Joint Planning Commission approved the final plat for PL2542, Big Creek Estates 3rd Addition, on March 25, 2026 by a 7-0 vote. The motion to approve was made by Mason Ruder and seconded by Ross Meder; the vote was unanimous.

County counsel Bill Jeter told the commission that, while legal avenues exist to stop construction occurring before plat approval, the county would need to prove irreparable harm and that the statutory and procedural timelines make immediate enforcement difficult. "The burden to prove irreparable harm would have been on the county," Mr. Jeter warned, and he said the platting process would likely be complete before some legal remedies could take effect.

Justin Craig, Environmental Services Director, reviewed the commission's outstanding concerns and verified their status. Craig said staff had reviewed the final plat and covenants and restrictions, confirmed the need for an original copy when the plat is presented to the Ellis County Commission for approval, noted a required letter to proceed from the Big Creek Improvement District, and checked sightlines at the corners of the plats and tax-payment status. Craig reported that previously identified concerns remained addressed in the final plat.

The commission had no further questions and voted to approve PL2542. The approval recorded at the March 25 meeting follows staff review and counsel guidance; the record notes that the county's options to reverse or halt work already completed may be limited absent a showing of irreparable harm.
