Commissioners recorded that Allied Technical Services (Contract C-1 Underwater Intake Rehabilitation) and Bowen Engineering (Contract C-2 Caesars Creek Intake) will have contract language added to name Wilmington as an intended third-party beneficiary, require warranties of materials and workmanship, add the City as an additional insured on applicable insurance policies, and require ORC-compliant surety bonds naming Wilmington as a co-obligee.
Both change orders state the provisions apply retroactively to work performed to date and require contractors to provide updated certificates of insurance and bonding within 15 to 30 days. The minutes note those amendments do not change contract amounts or contract time "except as expressly provided herein." Commissioners voted aye on both change orders.
