Excavating, Inc. awarded Valley Street project after low-bid compliance issue; cost-share set at 45%

Bids for the Valley Street project were opened and read by HDR: Excavating, Inc. ($537,676.02); DL Barkie ($518,940.00); Gratech ($626,683.63); Hansen's Excavating ($651,280.00); Bluestone Construction ($711,197.00); Wagner Construction ($692,794.00); Dig It Up Backhoe Service ($1,019,286.00). One bid was rejected without examination for failing to include a separate envelope with the bid bond and contractor license.
Roger Kluck moved to accept Excavating, Inc.'s bid because the apparent low bidder did not provide required written evidence of qualifications (financial data, previous experience and present commitments) as required by the bidder instructions. Chair Tom Klein disclosed an employment relationship with DL Barkie and did not participate in the discussion or vote. The board directed Attorney Bryan Van Grinsven to draft notification letters to bidders; the motion passed 5-0.
HDR's Chris Korkowski advised that the project is now classified as a surface drain project and that drop structures are not considered bank stabilization; Abigail Franklin of the North Dakota Department of Water Resources said that classification results in a 45% cost-share rate and that lower bids can affect cost share. The board moved to submit the cost-share application as soon as possible. HDR also presented Amendment #1 to the Task Order to include construction management services at an additional $96,715; the board approved the amendment 5-0.
The award, cost-share application and HDR amendment together set the immediate procurement and project-management steps for the Valley Street project. HDR was authorized to move forward with construction management and the board authorized staff to submit the NDDWR cost-share application promptly.
