The Seven Hills City Council voted to grant a 10-foot zoning variance for property owner Frederick Brumfield at 5670 Essex Drive, allowing a proposed 12-by-16 accessory building to sit 20 feet from the side lot line instead of the required 30 feet.
Councilperson Stacy Kelly reviewed the Zoning Board of Appeals record, saying the applicant contracted a contractor to install a gravel pad that was placed 10 feet closer to a required drainage easement than intended. "If he was to move it back another 10 feet, it would cost him another $2,100," Kelly said, and noted the yard’s slope toward the drainage ditch as a practical difficulty cited in the ZBA finding. She stated the ZBA had no engineer objections and no residents spoke for or against the request; four of five ZBA members voted in favor.
Councilman Snitsky moved for a council vote and Stacy Kelly seconded; the body approved the variance by voice vote. The council recorded the motion as a formal vote to adopt the ZBA decision and the variance was entered on the council’s docket as approved.
Next steps: the variance takes effect per local procedure; the council did not record any conditions beyond the variances described in the ZBA report.
