County Attorney Wes Schemenaur presented an overview of a new contracting law and proposed a county contracting policy (Ordinance 2024‑15) that would require standard contract provisions: contracts in the name of “Jay County,” an indemnification clause, mediation before litigation, Indiana law and Jay County venue, defined terms and termination clauses, and notice procedures to commissioners, auditor and county attorney.
Schemenaur said a standard addendum would be drafted for county contracts and that the new statute establishes a 20‑day review window. He noted elected officials remain responsible for statutory or constitutional duties and that commissioners could void contracts not following required procedures. Commissioners asked about the 20‑day period and were told it is statutory and cannot be changed; the attorney said the timeline should be manageable when staff provide contracts in advance.
