Resident raises fence dispute; board schedules March 4 viewing and agrees to written fee allocation

Eugene Wenke of Mt. Sterling appeared to ask the board (acting as Vernon Township trustees) to confirm how fence-viewing costs would be allocated and whether photographs or electronic text messages may be accepted as evidence in a partition-fence dispute. Wenke said he filed a Notice of Adjoining Landowners on Feb. 10, 2025 and provided Document #2025-206 as proof of an original agreement formed about 35 years earlier that addressed fence maintenance and responsibility.
After discussion, the board told Wenke they will work to determine what is equitable and agreed to provide something in writing about how fees will be allocated prior to the fence viewing. The board also said at least one trustee will personally inspect the fence rather than relying solely on pictures or text-message evidence. The board set the fence viewing for March 4, 2025.
