Commissioners told staff they had little confidence that conditions would be followed at the ATR Services site given past unpermitted work. Chair Len Goodwin said he "did not see how the Commission could move forward given an unresolved fire hazard on the site," and commissioners cited both the absence of State Fire Marshal permits and the proximity of stored firewood to above-ground fuel tanks as evidence the site posed an urgent compliance problem.
Staff said that denying the land-use applications would not preclude continued code enforcement actions related to stormwater and that the applicant could appeal the denial to the City Council; staff noted that if the decision became final the applicant would be barred from resubmitting for one year unless material changes such as State Fire Marshal compliance occurred.
