DRB approves conditional-use for 220 Green Mountain Road short-term rental with safety and occupancy conditions

The Town of Montgomery Development Review Board on Sept. 25 granted conditional-use approval to convert a single-family home at 220 Green Mountain Road (parcel 00005.007X) into a lodging establishment for short-term rentals. The motion, moved by Sue Wilson, passed 4-0.
Lynda Cluba, agent for applicants Morgan Cluba and Anthony Gervais, told the board that the owners live in Washington State and "are requesting a maximum of 8 guests," and that the four-bedroom house would be listed exclusively on Airbnb with a designated local contact when rented. The board accepted a packet from the zoning administrator, which included the application, public notice, certified-mail list and proof of landlord/vacation-rental insurance.
The approval includes conditions recorded in the applicants' materials: a maximum occupancy of eight guests; a limit of four parking spaces; rental insurance on file; no overnight camping; posted quiet hours (listed in the submitted materials as 10 p.m.–7 a.m.); house rules and emergency/911 information posted inside the home; exclusive listing on Airbnb (with state registration required if rented otherwise); a local contact within 25 miles (initially Lynda Cluba; Elliot Cluba when she is unavailable); required fire extinguishers and smoke/CO detectors; compliance with Vermont Division of Fire Safety inspection and Vermont State Fire Marshal verification; water and septic compliance with DEC regulations; and prohibitions on pets, parties and large events.
The minutes record the motion passing 4-0. The board moved on to a second short-term rental hearing later in the meeting.
