The Board voted June 29 to authorize the county’s approval of a proposed settlement resolving claims by Morgan Enburg and David Melchert arising from alleged wrongful removal of trees on their rural Clinton County acreage. County defense counsel for ICAP reported a tentative mediation agreement reached June 24 under which the claimants would accept $150,000 in full and final settlement; the Board approved the county’s authorization to proceed if there is no county objection.
The motion to authorize the Chairperson to sign settlement documentation was made by Supervisor Jim Irwin and carried unanimously (Irwin: Yes; George: Yes; Srp: Yes). County counsel will prepare a settlement agreement and release if the county proceeds without objection.
