Councilwoman Lupita Conner objected to approving the purchase without a public hearing, stating there could be a "violation of public meeting rules for action without a hearing" and citing state code 50‑1403. Ahlborn responded that after reviewing the municipal code "it does not look like it is required to purchase, but we will consult with the City Attorney." Mayor David Porterfield confirmed the City Attorney had been consulted before the vote.
The purchase was discussed after the council returned from an executive session that minutes record as held under Idaho Code 74‑206(1)(c) for acquiring an interest in real property. The council adjourned at 9:49 PM following completion of the agenda.
