Court approves second reading of zoning changes to allow "qualified manufactured" homes in single-family zones

On second reading the Boyle County Fiscal Court approved amendments to Articles 2 and 4 of the county planning and zoning code to describe and regulate manufactured, modular, mobile and newly defined "qualified manufactured" homes.
Planning staff Hannah explained the state mandate required the county to add language allowing "qualified manufactured homes" in single-family residential zones, provided they meet construction, facade and materials standards. Hannah said qualified manufactured homes must have building materials within the last five years and must meet minimum living-area standards discussed in the draft. "The qualified manufactured home number d or option d says has a minimum total living area of 900 square feet," Hannah said during the discussion. Magistrates raised concerns about how strike-through edits appeared in the digital packet and requested clearer printed copies for the record.
Magistrates and staff also discussed accessory dwelling units and whether deed restrictions or homeowners'associations could still prevent placement of such homes in subdivisions; planning staff confirmed deed restrictions/HOAs remain enforceable as civil matters. The court voted to approve second reading by voice; the measure will proceed to final adoption on the required schedule.
