Committee hears that overcapacity finding could restrict new charter openings and make vacant low‑quality sites ineligible

During the Policy HG presentation, Lagana described concrete operational effects that would follow an overcapacity finding.

She said the policy and recent state legislation would bar the opening of new schools in the grade span where the district is in overcapacity, subject to limited exceptions such as approved transformations. "No new schools may open in the grade span of that where you are in overcapacity," Lagana said. She also said charter contracts could be terminated prior to their expiration as part of portfolio management when overcapacity exists — a notable change from jurisdictions where authorizers cannot close charters solely to reduce seats.

The draft additionally clarifies that low-quality vacant facilities would not be required to be made available to new charter operators during an overcapacity period; the district may choose to make high-quality facilities available but is not obligated to do so. Board members asked whether the prohibition would prevent other authorizers or charter actors from pursuing openers through separate authorization processes; staff said the policy text "doesn't speak specifically to that" and recommended confirming the district's authority in follow-up research.

Committee members asked for clear public reporting and for the administration to explain how these restrictions would interact with charter renewal processes, renewals timing, and other authorizing bodies.
