LCB staff recommend denying petition to let prepackaged food count as 'complete meal'

Daniel, speaking for the director's office, previewed a recommendation that the board deny a March 3 petition from Barbara Jones on behalf of White Horse Saloon asking that preprepared or prepackaged foods be treated as "complete meals" for licensing purposes. He cited statutory language that defines a restaurant as an establishment for preparing, cooking and serving complete meals and explained current rule language excludes items that "consist solely" of precooked frozen meals, carryout from another business, or snack food.

Daniel said the petition's primary arguments were economic—concerns about the cost of fresh food—but staff concluded that allowing wholly prepackaged offerings would undermine the statutory concept of a restaurant as a place that prepares and cooks meals. "It just can't be entirely prepackaged or entirely pre frozen," he said, explaining current rule uses the word "solely" to exclude those items from counting as a complete meal. Members asked whether the board has authority to change the definition; Daniel said the board does have statutory authority to define a complete meal but urged caution given prior enforcement issues and possible need for clearer legislative guidance. Daniel said he would present the formal recommendation at tomorrow's board meeting.
