Commissioner (speaker 3) moved for a short executive session citing attorney–client privilege on an agenda item. County legal counsel (speaker 5) cautioned that, "It's been my practice to recommend, that any executive session always be included on the agenda that's sent out early, to the public," and urged caution in adding sessions after the agenda is published. The motion to hold an immediate executive session failed on a roll‑call vote. Commissioners then considered tabling item 6C — related to easements and the McNew–Mills Road project — to allow staff and negotiators more time to work with affected property owners.
Counsel explained the step under consideration would authorize staff to prepare an eminent‑domain petition, a procedural step the county uses when easements or property rights cannot be secured by agreement. Counsel said tabling the item until Aug. 12 would not likely block the project's bid schedule because the petition documents were not yet ready. After discussion, the commission voted to table 6C to the Aug. 12 meeting so members could seek additional information and allow for private negotiations ahead of any further action.
