Commissioners recommend rezoning 514 acres to Agricultural Heritage Zone to protect dairy farm

The Box Elder County Planning Commission on May 21 unanimously recommended that the county commission rezone 514.2 acres owned by representatives of Capener Brothers Dairy LLC and Jeffrey Rigby from unzoned to the Agricultural Heritage Zone (AHZ).
Staff presented Z26-008, saying the proposal covers parcels north of Riverside and north of Plymouth and identified surrounding uses as rural residential and agriculture. Staff reviewed the four rezoning standards used by the county: consistency with the General Plan, harmony with nearby development, potential adverse effects on adjacent property, and adequacy of facilities and services.
Applicant Neil Capener spoke during the public hearing and urged approval, saying the farm is being encroached upon by housing and “would just like to continue farming.” After closing the public hearing, Commissioner Jed Pugsley moved to forward a recommendation of approval to the county commission adopting staff findings and conditions; the motion was seconded by Commissioner Jared Holmgren and passed unanimously.
The commission’s recommendation included staff conditions requiring compliance with Article 5 and Article 2-2-080 of the Box Elder County Land Use Management & Development Code and all applicable county, state and federal laws and permits. The county commission will consider the rezoning recommendation at a later date.
