Panel advances bill allowing licensed private ABA providers campus access with MOU and IEP coordination

Representative Martin (speaker 8) told the subcommittee HB 2327 is intended to provide families more options: licensed private-pay applied behavior analysis (ABA) providers could deliver services on school grounds after coordination with a student’s IEP team and execution of a memorandum of understanding.
"This bill requires our LEAs and public charter schools to allow licensed private pay providers of applied behavioral analysis services, or ABA services, access to students during the school day on school grounds … it requires coordination with the student’s IEP team and execution of a memorandum of understanding between the private pay provider and the LEA or public charter school as the service before the services begin," the sponsor said. He emphasized the bill is permissive and does not replace an LEA’s IDEA obligations or the district’s responsibility to provide FAPE.
Members asked legal and operational questions about scheduling, liability and whether the arrangement is consistent with existing rules for homeschool and virtual students. The clerk recorded five ayes, zero nos and one present not voting; the bill advanced to full Education.
