Board approves secondary dwelling for Peppler family at North Aetna Road
Summary
The board unanimously approved a special exception allowing a secondary dwelling unit at 3490 North Aetna Road for Ryan and Jamie Peppler; staff said a state legislative change removed the board’s authority to restrict income‑producing rentals, so staff struck that condition.

The Whitley County Board of Zoning Approvals unanimously approved 26WSE13, permitting a secondary dwelling unit at 3490 North Aetna Road to allow the petitioners’ parents to live closer to family.
County planning staff (Nathan) said the 2.5‑acre lot sits in a subdivision and that the proposed outbuilding will be closer to the road than the existing dwelling; staff recommended two standard conditions but removed a third condition that would have prohibited income‑producing rentals after a state legislative change took effect in July. Petitioner Ryan Peppler (3490 North Edna Road) said the unit will have its own driveway and that soil tests and a separate well are in place or submitted to the health department. Neighbors Harold Dunn and Gerald Dunn asked whether the unit would have separate well and septic; Peppler said soil tests have been submitted and the new building will have a separate well and two bedrooms.
A board member moved to approve the special exception with the conditions allowed by staff; the motion passed unanimously after a second and a voice/hand vote.
