Board approves fence replacement at 8134 Florence Ave; staff to prepare findings

On April 23, 2026, the Brentwood Board of Adjustment voted unanimously to approve a fence replacement at 8134 Florence Avenue for property owners Andrew and Htoi Jones. The motion to approve was made by Mike Besmer and seconded by Kristen McDaniels; the board then directed staff to prepare findings of fact and conclusions of law.
Applicant Htoi Jones, who was sworn in, told the board that a local fencing company had concerns about moving the fence farther onto the property because of a large tree, and that the family’s homeschooled children “spend a lot of time in yard.” Staff member Ms. Kelly presented the site plan and told the board the height, style and openness of the proposed fence meet code standards. Ms. Kelly also reported that staff consulted an arborist, who advised the tree would be OK if the fence were placed 5–8 feet away.
Board members asked clarifying questions about the property line and driveway gate; Ms. Jones said the driveway access will include a gate that is drilled into the driveway. Acting city attorney Mary Schnellmann entered the submitted materials into the record before the vote. The vote was recorded as unanimous in favor of the motion.
The board additionally voted for staff to draft the formal findings and conclusions required to document the decision. The Director of Planning and Development report and other agenda items were listed later in the meeting, and the board adjourned at 7:23 p.m.
