During new business the chair handed out the statutory text and a short decision tree summarizing July 2026 amendments to state zoning law, including changes that broaden the practical-difficulty standard for variances and create exceptions for nonconforming lots in certain circumstances.
The chair highlighted the statutory change: "The new section 10 effective 07/09/2026 replace a former substantial hardship only to soil conditions, shape and topography standard with a broader Practical difficulty standard," and said the board must approach cases cautiously because court and appellate guidance is not yet developed. Members discussed concrete case types that might be affected, including whether small additions on conforming setbacks or pools would now proceed by right, or whether many existing setback cases would still come before the board.
Several members asked for practical scenarios rather than only legal text; one member suggested inviting Amy (town counsel or representative) to a future meeting to present examples so board members can see how the amendments would apply to typical local cases. The chair said he will request an update from KP Law (or town counsel) and emphasised the importance of written findings if the board grants relief under the new standard. The board adjourned after the discussion.
