Property owner Ross Fanti requested a non‑zoning variance (NZVAR 2025‑25) from Land Development Code standards to allow an additional, reduced‑width driveway connection and relief from driveway construction standards for a pedestrian‑only driveway along S. Wilderness Trail. Growth Management Chief Engineer Clint Lynch discussed drainage and maintenance concerns; Fanti agreed to take responsibility for the culvert and swale.
Deputy County Attorney Kealey West recommended the Board require a "Maintenance and Hold Harmless Agreement" with the property owner to ensure long‑term upkeep; the Board included that as an amended condition. The Board voted 5‑0 to approve the variance based upon the staff report’s findings and conditions and amended the approval to require the maintenance agreement to run with the land.
