Commission approves vacation of cross-access easement at Ashbury Commercial; drainage plan required

The Planning & Zoning Commission recommended approval of VAC2025-02, a request to vacate a portion of the cross-access and cross-parking easement in the Ashbury Commercial Subdivision. Applicant Matthew Parks (Clark Wardle) said the parking built within the easement already satisfies the reciprocal-access intent and that vacating the unused portion would allow development of a planned research facility on Lots 7–9.
Rick Butler, planner with the planning department, told the commission that the subdivision's built parking serves the intended purpose of the easement and recommended approval with conditions. Butler explained that because the final plat and initial drainage calculations assumed no construction in the easement area, staff added a condition requiring a revised drainage plan be submitted for review by the city engineer before building permits are issued. "Before any building permits are to be issued, that a revised drainage plan would need to be submitted for the city engineer," Butler said. Commissioners moved, seconded and voted to approve the vacation with staff-recommended conditions.
The approval is conditioned on receipt of the outstanding written consents and the required drainage plan during subsequent permit review.
