ANCs and residents urge stronger noise enforcement; ABCA proposes bill to allow citations without entering residences

Noise enforcement emerged as a recurring theme: witnesses said ABCA's existing tools treat complaints as isolated incidents, require inspectors to enter residences to substantiate violations, and lack a public-facing complaint history. "ABCA can only enforce the latter, which is subjective and currently requires inspectors to go into a resident's home to substantiate," ANC1B chair Steven Hanrahan told the committee, urging a Noise Balance Amendment Act to create clearer, objective standards and avoid forcing inspectors into residents' homes at 2 or 3 a.m.
Director Fred Musale described the agency's proposed nightlife noise bill as designed to reduce the need for in-home substantiation and enable ABCA to issue citations for noise audible in residential areas within 15 feet of where the complainant lives. He said that noise complaints in the district have risen from 542 in FY22 to 1,333 in FY25 and that the planned Salesforce upgrade will include a public-facing noise complaint record to replace FOIA-only access. "One thing that... we're going to do is allow our ability to issue noise citations for noise heard in residential areas," Musale said. The committee signaled interest in moving the measure to committee referral and requested follow-up on practical enforcement details, including training and investigator staffing to support late-night enforcement.
