Counsel advised that selecting two trustees avoids Sunshine Law violations while allowing representation at a mediation table; the designees were not empowered to make final settlement decisions without reporting back to the full board.
Legal counsel summarized the delegations' role: "I don't believe there's any suggestion that, the 2 trustees who are designated to participate would have any decision making authority," and said the participants would engage, hear proposals, and report back to the board for any decisions.
