Committee backs stronger construction‑site rules, enforcement tools for right‑of‑way repairs

Town staff told the committee the Chapter 4 draft adds firmer construction‑site standards and stronger enforcement authority for code compliance staff. Heidi Siegel said the changes are intended to give the code compliance officer the ability to ensure contractors repair damage to curbs and rights‑of‑way and to require better site maintenance.
"This gives Jackie the teeth to follow," Siegel said, explaining the draft adds specific standards and enforcement language to the code. The draft calls for temporary construction fencing (6 feet tall) with a black or green coif to limit visibility, and allows aesthetic options such as artificial foliage panels. Committee members discussed locating the fence as close to the building as practical so contractors can park within the site rather than on the street.
Staff also described a practice of requiring pre‑construction photographs of site curbs, gutters and roadways so staff can document existing conditions and hold contractors accountable for new damage. Members discussed how permit and certificate‑of‑occupancy processes can be used to ensure repairs are completed; staff said they had previously withheld permits over unrepaired curb damage and saw better compliance when enforcement was applied.
The committee asked staff to tighten any manufacturer‑specific language and to ensure the enforcement approach and contractor responsibilities are clear before the commission sees the ordinance draft.
