Hampton City Council approved an ordinance granting Lumos Telephone LLC a nonexclusive franchise to occupy and use public streets and rights-of-way to construct and maintain telecommunications network facilities.
City staff explained the company requested the franchise to provide services to city residents and that utilities performing work in city streets are required to restore the roadway to drivably safe condition. “When utility companies go into our city streets, they are required to put them back, to the condition,” staff stated during the presentation.
One speaker, Marissa Oakes, signed up to speak during the public hearing but said she did not have substantive comments and offered no objections. The council moved, seconded and approved the ordinance by roll call; votes were recorded Aye by council members present.
The nonexclusive franchise allows Lumos to construct, install and maintain network facilities subject to the terms in the agenda package, and the city retains requirements for restoration and compliance with applicable laws.
