South Bend council approves electric-vehicle charging station license agreement

The City of South Bend council voted May 28 to approve a license agreement for electric-vehicle charging stations, clearing the way for a developer to install, site, operate and maintain charging equipment on city premises.
Dennis, a city staff member who summarized the item for the council, described the agreement as straightforward and said it "fits well" for both parties. The chair noted attorneys for both entities reviewed the contract. A council member pressed for clarification on the underlined term "permitted use," asking, "What does permitted use? What does that entail?" The council clarified that the permitted use refers to installing, siting, operating and maintaining EV equipment and that the premises are shown on Exhibit A of the agreement.
Council discussion also addressed operating costs. A council member asked who would pay for electricity; the answer given was that the developer would cover electrical costs associated with the charging units. The council moved, seconded and approved the item by voice vote.
