City Attorney Stanley Smith told council the Maple Street widening project requires numerous drainage and widening easements along properties on Maple and South 14th; staff has sent initial and final offer letters and is seeking council authorization to file condemnation proceedings where negotiations have failed. Smith explained the packets to landowners include a third-party appraisal, a copy of the proposed easement and the statutorily required landowner bill of rights.
Council considered and approved a series of individual resolutions (items 15–28) authorizing the use of eminent domain for specific small easements (ranging in the record from about 0.006 to 0.487 acres). Smith said staff has negotiated and obtained acceptance on 25 easements so far, and council-approved resolutions authorize the city to file condemnation suits if owners do not respond to final offer letters; multiple residents asked for clarification about the process and compensation, and Smith replied owners would receive appraised fair-market value.
