Avon IWC approves emergency culvert repair and maintenance dredge at 65 Nod Road

The Avon Inland Wetlands Commission on April 1 unanimously approved Application #803, which authorizes emergency repair of a box culvert and maintenance dredging of a drainage creek at 65 Nod Road, a golf course property owned by Town Fox LLC and operated by Bozzuto’s, Inc.
Project manager John Ruzsbatzky told the commission the new owner inherited years of deferred maintenance and that the pipe and cart path had washed out during a storm, creating safety and access issues. Planning staff wetlands agent Emily Kyle said maintenance of existing golf-course drainage features is sometimes exempt but major culvert repair and in-stream excavation fall under the IWC’s jurisdiction and may require a permit or jurisdictional determination. "The repairs seem to be permitted as a non-regulated use within the recreation of golf and a golf course," she said of the maintenance exception, while noting the culvert repair itself required review.
Commissioners and staff agreed the immediate repairs were necessary to stabilize the site and allow safe reopening of the course; the motion to approve the application was made by Vice Chair Michael Sacks, seconded by Commissioner Carol Hauss, and passed unanimously. The applicant said future changes — including a proposed driving range and a second clubhouse — would be returned to the IWC as separate applications.
