Board attorney Sean Fredricks provided an update April 7 on the Hoplin/McLaughlin obstruction complaint and the parties’ revised settlement agreement. The Board previously directed Fredricks to limit the Hoplin parties’ liability in the agreement to damages caused by their activities and to require them to secure any necessary permits for a cleanout project; Fredricks relayed proposed modifications to the parties and the Board held the complaint in abeyance to allow direct negotiations.
Mr. Fredricks told the Board he recommended the parties contact each other directly; the minutes record that Hoplin’s attorney has now reached out to David McLaughlin to negotiate. No formal action was taken at the April 7 meeting beyond the status update and the Board’s continued hold of the complaint in abeyance.
