The Board of County Commissioners of Kay County on March 16, 2026, tabled consideration of the National Prescription Opiate Litigation settlement (Case No. 1:17-md-2804) after District Attorney Brian Hermanson said he had reviewed the 48-page agreement and requested additional guidance from the attorneys handling the case.
Hermanson told the board he had emailed the attorneys and "recommended that the BOCC table this item until further guidance is received." Commissioner Shane Jones moved to table the settlement; Chairman Jeff Kreger seconded the motion, which carried with both commissioners voting aye.
The item will remain tabled while the district attorney awaits written direction from counsel. The transcript does not specify a new review date or whether the settlement would require further board action should counsel recommend acceptance.
