Huachuca City council orders active code enforcement despite potential legal risks

Town Manager Suzanne Harvey told the council on March 26 that staff has heard resident concerns and asked whether the council wanted more aggressive enforcement of the Town Code covering zoning, health and safety, buildings and construction and neighborhood preservation. She told council staff had discussed enforcement with Dr. Johnson and the police and warned that stronger enforcement "may end up in court" and could cost the town money.
Council members voted to direct staff to pursue active enforcement and to apply the code equally across the community. Mayor Johann Wallace confirmed the council’s direction toward active enforcement. Attorney Thomas Benavidez cautioned that pursuing enforcement could require legal expenses but did not recommend against enforcement. The council did not adopt a new ordinance at the meeting; it provided direction for staff to proceed and to return with any ordinances, costs or legal analyses as needed.
