ZBA approves land-division variance to allow conservation donation at Oakdale Park property

The Clinton County Zoning Board of Appeals on April 21 approved a variance allowing a land division at 9306 Oakdale Drive in Victor Township that would create one conforming parcel of roughly 0.49 acres and a nonconforming remainder of about 0.29 acres. The applicants, Donn and Kathleen Miller (Trust), said the remainder would be donated to a conservation project and managed for preservation and research.
Interim Planning & Zoning Director Lynn Wilson presented the application and staff findings. Lynn Wilson said the property consists of six platted lots combined over time and described the staff determination that the seven general conditions in §7.20(F)(1) and a special condition in §7.20(F)(2) (provision b) were met. Donn Miller testified to the property's environmental characteristics and intended use, saying, "the property would be donated to the conservation project if the variance is approved," and describing woodlands, a bog with vernal ponds and undeveloped river frontage.
Board members asked about notice and the receiving organization's protections; Lynn Wilson confirmed that property owners within 300 feet were notified and that notice was published in accordance with ordinance requirements. Donn Miller stated the land is under a 100-year PA 116 agreement and a conservation easement with Mid-Michigan Nature Association (now Michigan Nature Association), and that the site will seek grants and collaborate with Michigan State University as a research facility.
Kathleen George moved and Kim Wieber seconded a motion to approve Variance Request ZC-01-26 (PVR260001). The motion carried by roll-call vote, 5-0 (Kathy/ Kathleen George — Yes; Keith Jones — Yes; Kim Wieber — Yes; Greg Armbrustmacher — Yes; Mark Winsor — Yes). The approval authorizes the described land division; staff and the applicants indicated the next steps involve finalizing the parcel split and documentation for donation and conservation easement.
