The Washington State Liquor and Cannabis Board on July 1 voted to deny a petition requesting expansion of allowable canopy for Tier 2 outdoor cannabis producers from 10,000 to 30,000 square feet.
Daniel Jacobs presented the director's office recommendation to deny a petition submitted May 5 by Jessica Strait and Kenny Ingebrigtsen on behalf of Eagle Trees Farm. Jacobs cited the Whitney Economics and JLARC reports and ongoing stakeholder feedback that Washington already has substantial canopy capacity and that allowing a broad Tier 2 expansion would likely exacerbate oversupply concerns. He also said petitioners have an existing administrative avenue to obtain Tier 3 licenses and that licensing staff do not currently track whether individual producers use indoor or outdoor cultivation, complicating any effort to separate the classes by cultivation method.
Jacobs recommended denial and described practical and resource challenges in distinguishing indoor from outdoor producers for rule enforcement. Board member Holmes disclosed receiving communications but said it did not change support for the director's recommendation. Pete moved to accept the director's recommendation to deny; Ali seconded. The motion passed unanimously, 3-0, and the petition was denied.
